I love that Justin plays basketball. (Nellis-verse Sam who met Kara on the b-ball court approves)
I also really loved that he was pissed about the ring tone. I like how it reflects back on the earlier eps and how she was angry (and teasing sometimes) about how he doesn't care. It's one of those things I find very believable, that you can accept teasing for so long, but after awhile it starts to feel true and you see it everywhere. So because she has twitted him so much and so often about not caring about other people, he then focused on the very literal part of the Tin Man being heartless. And instead of reminding him that Tin Man actually DID care, she answers him with sexual innuendo. So what Justin hears is "yep, I still think you're a dick, but you're hot in the sack. so I'll overlook it while we makeout some more."
Ironically, of course she's the one that ties his upset with the ringtone with his buddy Chuck's unhappiness with the jersey, and yet, when he says he apologized, wouldn't that be your cue to also apologize? Or demonstrate that you changed it, or tell him that Tin Man actually had the most heart of them all? I don't know, something. It's just so frustrating that she realizes that she hurt his feelings but seems to think that just because he's willing to talk to her later that it doesn't matter.
Of course the way he keeps coming back doesn't help. I get that he would rather work things out, and he obviously still loves her, but from her side, it can't be THAT bad since he's still talking to her and coming to her boat all the time or having lunch together (and generally seeing each other more than they did when married). But it does seem that Justin's doing more pulling back while Kate is realizing how much she doesn't want that.
The final scene with them was just beautifully done by both of them - when he realizes he's going down that same road again and lets her go, and Sarah's face, watching Julie dance while Justin's got his back to the whole thing.
Anyway, six week courtship followed by constanty working. Uh huh. That would be why they never learned to talk. They never had to.
So now it turns into a question of whether she's willing to do a little more heavy lifting in their relationship than coasting along in Friends-with-Benefits, or if she's going to let him go.
The funny thing is, the original issue of having no time for each other isn't true -- Justin clearly has some seniority in his office (prosecutors have decent hours when they're not in trial, and supervising prosecutors are rarely in trial), and now that Kate's not litigating anymore, even though she's obviously still busy, it's not the 80+ hours she probably was doing at the firm before. It's a matter of re-prioritizing what she does do.
Hopefully we'll get to see how it shakes out, since I doubt there will be a resolution in the finale.

I don't think she signed the divorce papers -- seems like we woud've seen that (and I think the promo has a bit with her looking at the papers again).
And I have to agree that until she learns it's a two way street, he has to pull back. He's been slowly feeling his way to not wanting this casual fling thing they were doing, and now he just has to stick to it.
S2 - Kate and Justin go to marriage counseling....
